Judge Won’t Delay Tracy Morgan Lawsuit Against Walmart

Tracy Morgan and his lawyers won a court victory last week. The judge in the case rejected a request to delay Morgan’s lawsuit against Walmart. Tracy and others were severely injured in June when a Walmart tractor trailer driven by driver Kevin Roper slammed in the limo that Tracy Morgan was traveling in on the New Jersey Turnpike.
According to the Hollywood Reporter, Roper wanted to delay Tracy’s lawsuit against Walmart until his own criminal case in the accident is resolved. U.S. District Judge Michael Shipp ruled that was no reason for a delay in the lawsuit proceedings. He said in a statement, “Mr. Roper has not demonstrated that his Application requires emergent relief. Here, Mr. Roper’s lack of urgency, as reflected by the submission of his Application five months after the Complaint was filed and three weeks after the Court’s Scheduling Order was entered, undermines his claim of immediate and irreparable harm.”
Tracy Morgan’s attorneys also argued that they believe that Walmart has unsafe trucking practices that also need to be resolved as quickly as possible. Part of the lawsuit against the company is that the amount of hours that Kevin Roper was on the road before the accident was part of the cause of it.
