James McNair’s Family Received $10 Million Settlement From Walmart

In January, Walmart settled with the family of James “Jimmy Mack” McNair who was killed in the June, 2014 accident involving Tracy Morgan’s limousine on the Jersey Turnpike. The terms of the settlement were kept confidential until now. Jimmy Mack’s family received $10 million from the company. As part of the agreement, Walmart did not accept any of the blame in the case. It was a Walmart tractor trailer that slammed into Tracy Morgan’s limo last Summer, killing McNair, and severely injuring Tracy along with Ardie Fuqua. Both Tracy and Ardie are still recovering from their injuries that included brain trauma suffered by both men.
Back at the beginning of the year when the settlement was announced, part of the confidentiality clause stated the amount paid to Jimmy Mack’s family couldn’t be revealed. According to E!, it was Jimmy Mack’s family’s lawyer who made the figure public in court papers in order to receive his legal fees from the settlement. Attorney Daryl Zaslow is getting paid nearly $3 million of the $10 million Walmart agreed to pay out.
Walmart still wasn’t talking about the money, but they did put out a statement saying, “We cannot discuss the terms and conditions of the settlement, but we are glad to have reached an agreement. We deeply regret the loss of Mr. McNair as a result of the accident. Walmart worked closely with his family to ensure their wellbeing. Walmart will continue to work to conclude all of the remaining issues and we’re committed to doing what’s right.”
Jimmy Mack’s daughter Danica McNair said, “While no amount of money could replace my father, the amount of money Mr. Zaslow was able to obtain again greatly exceeds anything I imagined and I could not be more grateful.”
Tracy Morgan still has his own lawsuit pending against Walmart for the accident.
