You Text Someone. They Crash. Could You Be Responsible?

Have you ever sent a text to someone while they were driving?  You might want to reconsider, because later this month a New Jersey Judge will decide whether a person who texted a driver can be included in a lawsuit for wrongful injury.  The decision could set groundbreaking precedent.

David and Linda Kubert were on a motorcycle in 2009, and both lost their left legs when a 19 year old crashed into them while he was texting.  The Kuberts, not surprisingly, are suing the 19-year-old driver.  They are also suing the person who was texting the driver.  The Judge will rule on whether the texter can be included in the lawsuit on May 25.
