Jimmy Mack’s Kids Talk About Their Settlement With Walmart In The Tracy Morgan Accident

Last June, when a Walmart tractor trailer slammed into Tracy Morgan’s limousine on the Jersey Turnpike, there’s was one fatality. That was James McNair also known to his comedy fans as Jimmy Mack. This week it was announced that Walmart had settled with Jimmy’s family. Entertainment Tonight was able to talk to Jimmy’s kids, Denita and Jamel about the agreement.

The family’s attorney Daryl Zaslow said, “The amount of money was more money than could have reasonably been anticipated to have been recovered under the law.” That’s about as much as the McNair family or their lawyer can say. Part of the settlement was a confidentiality agreement to not discuss actual figures in the case. Zaslow added that Walmart ultimately “did the right thing”.

A spokesperson for Walmart said, “We know there is nothing we can do to change what happened to Mr McNair. We’re committed to doing what’s right.”

James “Jimmy Mack” McNair met Tracy Morgan 20 years ago when they were both working at the Uptown Comedy Club in Harlem. After Tracy went on to Saturday Night Live, Jimmy freelanced as a sketch writer for him. At the time of the accident, Tracy and Jimmy had been working on material together for Tracy’s act.

As part of the McNair settlement, Walmart has not accepted blame for the accident and other lawsuits are still pending including ones from Tracy Morgan who is still recovering from a head injury and broken bones plus Ardie Fuqua and Jeffrey Millea who were in the limo that night and were severely injured. Fuqua is still in a rehab center recovering from brain trauma.
