Man accused of not paying for soda at McDonalds could get 5 years. Mark Abaire, 52, is facing a felony theft charge after being accused of walking out of the McDonald’s in East Naples without paying for a $1 cup of soda. Abaire has previous petty theft convictions, so the charge for drinking the unpaid-for soda was bumped up from a misdemeanor to a felony. Florida you never fail to entertain.
