Gay Son Has to Marry a Woman to Get Inheritance

To get access to a $180,000 dollar trust, the gay son of a Manhattan businessman has to marry the surrogate mother of his child according to the fathers will. Frank Mandelbaum’s will specifically states that none of his cash can go to the son, Robert Mandelbaum, if he “not be married to the child’s mother within six months of the child’s birth.”

The son is arguing that his partner, whom he married shortly after his childs birth by surrogate, is the only “mother” the child’s ever known. He also states in court papers that the will is illegal because it “imposes a general restraint on marriage by compelling Robert Mandelbaum . . . to enter into a sham marriage”.

The child is 16 months old, so unless NY state sees Robert’s husband as the kid’s mother, Rob may be out of the cash. Does he have a legitmate claim? Or should the courts respect Frank Mandelbaum’s wishes for the money he earned?
