Texas Executes Man With an IQ of 61

Marvin Wilson was executed in Texas despite his attorneys arguing that he should have been ineligible for capital punishment because of his low IQ. Wilson’s IQ is 61, below the generally accepted minimum competency standard of 70 which is only 3 lower than the Texas average IQ of 73.

if you're pro death penalty why not kill all the crazy people and retards first?

 

Murder, especially premeditated, is rarely a sane or rational act.

So the very act of commission would suggest insanity or idiocy.

I thought all IQ and other intelligence tests were inherently racist, i.e. blacks scored artificially lower on them compared to whites due to intrinsic biases in the testing methods?

 @Mikfin No, they are not racist.  There are objective differences between phenotypes on all levels.  With this in mind, IQ tests are irrelevant to anything other than taking IQ tests.

Whether or not you are a proponent of the death penalty, the current statute, including precedents set by State Supreme Courts and the USSC, allows for this man to be executed.  The USSC issued the opinion in Atkins V Virginia that executing the mentally handicapped was a violation of the 8th Amendment.  However, the burden to prove insanity befalls the defense.  His attorneys did not satisfy State Supreme Court.  Even though they're from Texas, the justices sitting on the State Supreme Court are some of the brightest minds in the country.
